Na última terça-feira (11), a 2ª Vara do Trabalho de Santarém, julgou totalmente improcedente a ação do Sindicato dos farmacêuticos de Belém em face de Sindicato Intermunicipal dos Farmacêuticos da Região Oeste do Estado do Pará – SIFROEPA.
Na referida ação, o Sindicato dos Farmacêuticos de Belém, requereu a anulação de todos os atos constitutivos do SIFROEPA, alegando o princípio da unicidade sindical. Além da abstenção do sindicato intermunicipal de fazer qualquer divulgação, filiação em favor dos farmacêuticos da Região Oeste do Pará, sob pena de multa por descumprimento.
Em sua defesa, o SIFROEPA, argumentou que não houve nenhuma ilegalidade ou irregularidade no processo de criação do sindicato intermunicipal, assim como, não houve lesão ao Princípio da Unicidade sindical, uma vez que a menor base territorial de um sindicato é o município.
Afirma ainda que, a Constituição Federal garante o livre direito de associação sem a interferência dos Poderes, exceto para coibir abusos e irregularidades. E que a decisão pela criação de uma nova entidade em uma base territorial reduzida, cabe unicamente aos profissionais residente na base territorial.
Em seu dispositivo, a sentença é clara ao julgar totalmente improcedentes, com resolução de mérito, os pedido do sindicato autor, mais a condenação ao pagamento de custas processuais e honorários de sucumbência.
O Sindicato de Belém, poderá recorrer da decisão, porém deverá fundamentar seus pedidos, sob pena de interpor recurso protelatório, e ter aumentado o valor das custas e condenação.
Com a decisão da justiça do trabalho, os Farmacêuticos da Região Oeste do Pará têm a garantia de que o SIFROEPA é uma entidade legal e regular. O processo de registro sindical já foi iniciado, aguardando apenas a análise dos documentos, para a expedição da carta.
A Diretoria do SIFROEPA e a assessoria judicia analisará a necessidade de juntar esta decisão judicial ao processo administrativo para expedição da carta sindical.
